Can I sue my landlord?

When we rented our house, 3 years ago, the landlord did not tell

us that we would be paying for the sewer, trash and

water and gas for the two apartments upstairs. The

way I found out was that the lady upstairs asked if

I could turn up the water heater and that on our

gas bill we were on commercial billing, instead of

residental billing. When I confronted the landlord,

he said that he did not know that the house was set

up like that. Three months later, he put in another

gas meter, but for the past 3 years, we have still

been paying for the sewer, trash and water and gas

for the one water heater this house has for us and

the tenents upstairs. The previous tenents upstairs

were on Section 8 and on their lease it said that

the landlord was responsible for all utilies but

electricty, when really we were paying for it. Section 8 was giving him rent as if he was paying

the utilities for the two ladies renting on Section

8. Do I have a case against him and could I get

him in trouble with Section 8?

I do not know the section 8 ramifications, but you have a case against the landlord, for actual damages and fraud, it is not likely a judge or jury will believe his story.
