Legal Question in Real Estate Law in Illinois
Can I sue a real estate agent for misrepresenting the market price of a home. I live in Illinois.
The agent sent me this email around October 2009.
"Bob,I just received a call from Paula about Millies home in Peru.I know this sounds unbelieveable,but she gave Paula permission to offer you her home at 147,000.If your interested and want to look at it one more time I can set up a showing for tomorrow at 5:30.Think about it and I will see you at Rock st at 5:30 today.Also would you like to look at the Ranch on 25th street again.I have time today or tomorrow.Sincerely,"
Paula is the agents buddy, and worked for the same agency. Just that the email is put in a way that the home is a deal at that price.
That would put this 1302 square foot home at 112 dollars per square foot. I found out later that most homes at that time were selling for 90 per square foot or less. I know there are alot of variables, but in hindsight 112 per square foot was definetly too much.
The agent was working for me and was suppose to be representing me. Just wondering if there is anything that could be done legally to try and recoup the 30 - 50K or so difference.
There was an appraisal. It came in at 148k. I think someone told the appraiser and they were just hitting the number. They used lingo like, asking price was a consideration and the property appraised for 10 percent or more than other properties in the area.

I tried to answer this for you on AVVO. Now you indicate there was an appraisal. The appraisal is for more than the price. Appraisers are licensed and have been under extreme scrutiny since 2008. I would not take your case.
