being sued for easement by necessity from neighbor.But dept of hwy says they will open guard rail to property at the owners expense, am i still liable

Generally, Illinois does not give private property owners condemnation rights over other private property. It is possible that there had been some access point across your land to your neighbor's property in the past that this neighbor is attempting to re-establish. So there is too little information in your question to be of help. Sine the neighbor has filed a lawsuit your best bet is to have an attorney review the situation for a more conclusive opinion.
