Legal Question in Real Estate Law in Illinois
Tenant leaves early per Landlord request. What happens to the lease agreement?
My husband and I signed an 18-month lease with a
management company working on behalf of the landlord
to rent their house. My husband and I are the tenants
and the owner of the house is the landlord. After
leasing the premises for 14 months, the landlord
requested to move back into the premises. The landlord
and the tenant come to an verbal and written (via
emails) agreement that the tenants would move out and
the landlord would regain ownership of the premises
prior to end of the original lease agreement. As
agreed verbally and written (via emails), the tenant
move out and the landlord moved back into the
premises. What’s the status of the original lease
agreement? Is it void or valid? Are the tenants
responsible for any terms or conditions related to the
original lease agreement? What’s the status of the
verbal and written (via emails) agreement?

The original lease still controls, unless there is a formal document terminating the lease.
Remember, the management company is still party to the transaction. You or the landlord may owe them money.
