Terminating Tenant Lease

Hello,

I need some advice. I am currently renting an Apartment. Four days ago a tenant of the building burglarized our Apartment. I found that there have been several break-ins in our building in the past year; but no notice were never put up to warn the tenants.

Eventually, our unit was burglarized!

The managers of the building suspected the perpetrators were the young men living in the building. They were arrested, but, released, and still residing in the building even though they confessed to the break-in.

I live with my sister and we do not feel safe living here anymore. What recourse can we take? We want to break the lease and move out. Can we legally do that? The landlord was aware of all the break-ins in the building and nothing has been done to date. Please offer any information you can; or references wecan look up.

You have a situation which is really problematic. I think that with proper legal representation, you could state a Constructive Eviction, especially if the landlord has not serve a 5 day Notice upon the offenders, i.e., is attempting to evict THEM.
