Legal Question in Real Estate Law in Illinois

Title References ''Condemned Land''

In reviewing the Warranty Deed and Title Insurance Policy for my property, I noticed an exception referring to the ''rights of the public'' and the local sanitary district to that part of the land ''condemned for sewer purposes on a petition of condemnation filed ...'' and a case number is listed.

I have a fairly good understanding of what an easement is, but what does it mean to have a portion of my property ''condemned for sewer purposes?'' I thought that once a person's land was condemned, it was no longer his land.

Re: Title References ''Condemned Land''

That's essentially what it means. Without reviewing your documents, I can't be certain, but from what you quote, it sounds like the sanitary district, through court order, took a portion of the property you purchased at some time in the past to put in a sewer line. May or may not be a big deal, depending on where it is, how big it is, and whether you were led to believe that you were purchasing the condemned portion.
