Townhome Special Assessment by Builder

My builder, who is now the acting board of directors for our association wants to issue a special assessment to our townhome association so that he can put the final layer on our road. He did not take a bond out with the city, as we have been designated a private road. I feel that finishing the development is his financial burden, not ours. Can he legally do this? That is, can he charge us for something without our consent and force us to pay? Please help!

It's impossible for me to answer this question without looking at the documents involved (and probably doing research too). Perhaps an attorney who specializes in representing associations would know off the top of his head. Try calling Elliott & Associates in Des Plaines as they do that type of specific work. If they can't help you, you'll probably have to hire an attorney to research it.
