Trespassing on property maintained by parents for 30 yrs
We rent from my parents last year my husband removed a broken down retaining wall that was falling all over my parents property. Before he could start putting the new one up we recieved notice that we are being sued for damage and trespassing by the neighbors who found out the broken wall was on thier property. the neighbors watched my husband for 5 months tearing down the broken concrete we even used thier driveway to help haul the old stuff out. We are renting the property and we are the only ones named in the suit, we are now broke because we had to hire an attorney.
What happens to us if we cant pay the attorney any longer and no agreement is reached? Can they garnish wages etc..?

If they get a judgment, they can enforce it by a wage garnishment, which would be 15% of your net wages as defined by statute. A Chapter 7 bankruptcy could be an option, especially if your attorney sues you for fees.
