Legal Question in Real Estate Law in Illinois
Urgent. Father in law was a victim of one of the worst cases of elder abuse the Chicago, Cook county detective had ever seen. I now have POA for him to help try and re gain some assets. Neighbor girl he knew since she was a kid wiped him of over $500k including foreclosure of his home. The motion of surplus was received and i know i need to submit the form to all parties listed on the foreclosure. The court date is set for Dec 1 to see the chancellery judge to get the funds released to him. After learning of all this he suffered a massive heart attack and was in the hospital for a month. We have him in Cali with us now and will be caring for him from here on out. As POA can i fly to chicago for that court date for him for the surplus funds or do we both need to go? Any help with this is greatly appreciated. Is the check cut the same day? Im trying to figure out flights, can i go and handle for him etc.....

You may want to consider hiring a lawyer to represent your father's estate at the hearing on Dec 1. That way you can make sure that the surplus amount is protected and you make arrangements to pick up the check. Call our office at 708-971-0529 if you would like to discuss this further.
