Warranty Deeds

Is a warranty deed prepared in Cook County Illinois considered 'legal' if it the transaction is not completed - i.e., the property registered at the Registry of Deeds office. i.e., if the person who transfers the property dies the next day after signing the Warranty Deed.

Transfer is "legal", if all of the statutory requirements for a deed are complied with. However, if another deed is recorded prior to this deed being recorded then the transfer may be void. Also if a lien is filed before that deed was recorded the transfer would be subject to that lien.
