Legal Question in Sexual Harassment in Illinois
Sexual Harassment in High School
About 9 months ago, I (17 at the
time, a girl) sent a friend (16 year old
boy) a nude picture of myself. In
recent months, however, things have
soured between us, and he has taken
to posting the images of me, along
with sexual comments, on a forum
popular with people at our high
school.
I would like to talk to the
administration at our high school
about this incident, because his
harassment has been escalating, and
making me feel increasingly unsafe.
However, I'm aware that in some
states, I could be charged with
distributing child pornography just by
virtue of the fact that I took a nude
picture of myself and sent it to him.
I'm afraid that if I come forward and
tell my school's administration about
the sexual harrasment, I could legally
be charged with child pornography, in
spite of the fact that he pressured
me into taking the image of myself.
Is this a valid concern for me to
have, in deciding whether I should
speak to someone in my school's
administration about this?

Re: Sexual Harassment in High School
Hello. Your friend certainly is not a friend. Since this was 9 months ago, I presume he could be 17 now. It could be argued that your publication of the photo to him was personal and that you did not intend that he use it to exploit you. This young man's actions are criminal! Technically, you could file a lawsuit against him for slander and libel. This clearly has gotten out of hand and your ex-friend may be liable for negligent infliction of emotional distress. Will be happy to discuss this further and in more detail.
