Sexual Harassment or Privacy Invasion?

I have a friend who wrote an bad comment that had a sexual reference about the teacher's ''butt'' in another person's yearbook. The teacher found out and then my friend received a suspension. Now the principals are saying that the other student must return the yearbook to the school or they will both receive more suspensions for ''insubordination'' and maybe expulsions or lawsuits sexual harrasment. Can the administration do this?
