Child Support & Income Taxes

I need to know the law that states the father has the right to claim his children on his 2006 income taxes. The father has been paying 130.75 a week in child support and the mother only worked 1 week last year. She wont give me a release to claim my children.

If you can prove that you contributed over 1/2 of the care and support of the child, then you can claim him/her as an exemption.

One more thing: if your spouse is not signing the IRS form that would allow you to take the exemptions, you can try attaching a copy of your divorce decree to your return indicating the support that you are required to make. The IRS will accept this as an alternative.
