My claim for first time home owner credit was denied because I was not in a contract before the deadline date. I gave all this paperwork to the tax preparer and they still filed it. Is there anyway he can be held liable for filing this knowing if he had reviewed all my paperwork correctly he would have seen this.

If there are penalties imposed, you may attempt to negotiate with the preparer for coverage for the penalties and the interest on the penalties. If push comes to shove and the preparer refuses, you are going to find that small claims is your best option, the legal fees to have an attorney help you bring suit will likely exceed any recovery you can obtain.
