Estate Tax ID Number

My older brother died in 2002. A bank officer volenteered to assist me in setting up estate accounts from my brother's holdings. This bank officer used my dead brother's social security number for the estate tax number! Is the bank responsible for any IRS tax penalities? If so, what is the statute of limitations on this mistake?

I'm not quite clear on what you are asking. My question would be: what was the result of the bank putting the accounts under your brother's social security number?

Were taxes owed, returns not filed appropriately?

Was there a probate estate opened?
