Fraudulent conveyance

A former employer located in Chicago, IL filed a false 1099 for non-employee income for tax year 2004 on my behalf - I beleive it was a deliberate fraudulent filing. Although I was issued a corrected 1099, no filing was made with the IRS and I'm left holding the bag for the taxes.

What is my recourse against the employer?

First of all, you may not be left holding the bag. There are ways to argue your case with the IRS in order to avoid paying an unjust tax bill.

Secondly, it sometimes works to approach your former employer first to see if he wants to correct the situation before you start defending your position with the IRS, knowing that will possibly cause him difficulty with the IRS as well.
