Legal Question in Tax Law in Illinois

IL Department Revenue Letter

I got letter from IL Dept of revenue for sales tx as pending for the jewellery came to IL from India 3 year back. Actually one of my friend came to US and he asked me to get his jewellery shipped to my address with my name as he was staying with me and I did said yes.. there was no duties at that time but after 3 year i got a letter saying that i have to pay tax. I did mention to Dept that jewellery was not for me as it was for one of my friend who came from india and his brother only shipped him the jewellery. Later on he went back after staying 10 days in US and he did gave me a packet with jewellery saying that if I can ship it to NJ. I told okay and later I shipped it to NJ. Now I have that burden of Sales Tax ... Also I have taken letter from India from his brother shop who send the jewellery stating that the jewellery send was not for my personal us nor for sale it was to be shipped to NJ.. and i also have UPS recepit stating that I shipped jeweller to NJ. How can I come out of this problem...I was new to Country that time I was really not aware that this might give trouble to me after 3 years.

Re: IL Department Revenue Letter

Where did the Illinois Department of Revenue get a figure on which to impose a sales tax? Was there a custom's declaration?

There should only be tax assessed if there was a sale involved. From your posting, it doesn't seem that any sale was involved.

Therefore, if the amount you are being assessed is large, it would be worth it to have an attorney review the documents for you to resolve it.

If it is a relatively small amount (but one that you do not want to pay nonetheless), or if you can't afford an attorney, you might want to make an appointment with someone in the Department of Revenue in their Springfield or Chicago office to discuss the matter. The worst thing to do is to ignore it, as the State will continue their collection efforts against you and it will eventually go to an outside collection agency.

Good luck to you.
