Legal Question in Tax Law in Illinois

mchenry co. made a mistake on my home's sq.ft. and I have been over paying my assesed value for 12 years. do I have any recourse other than to correct the situation and get my property taxes lowered to what they should be?

The 2009 filing period for McHenry County Board of Review Complaints has passed. That being said, I would take whatever documentary evidence you have showing the proper square footage (i.e. Plat of Survey, Appraisal, Architectural designs, etc.) and bring it to your local township assessor's office. Township Assessor information can be accessed at: www.co.mchenry.il.us/departments/assessments/Pages/AssmtInfo.aspx.

The Assessor may request to have one of his "field officers" come out to the property to confirm the information you have presented.

If, in fact, there was an error in the characteristic of the property, the Assessor has the power to grant what is called a "Certificate of Error" which would enable a correction to be made on a prior year's assessment and thus, refund monies if an overpayment was made as a result of the errror. Many assessor's will go back multiple years, but it is completely in the discretion of the Assessor as to how many years to grant such a remedy, or whether to grant any relief at all.
