I have my parents who are US citizen living with me as dependent ( I am the head of the household) have no earned or non earned income in US, my father has small pension earned in India (remains in Indian Bank). Does my parents have to file taxes in US? Can I still claim them as my dependents?
1 Answer from Attorneys
In order to claim another related person as your dependent, the dependent must live with you and you must provide more than half the funds needed for their support for the tax year in question. Furthermore, in 2013, the dependent must not have more than $3,900 in gross income. If your parents are residing in the United States, they may be required to file US income tax returns based on their residency, and there may be a requirement to report the existence of foreign bank accounts. Consult with a tax professional to have the nuances of your situation properly considered.
