Senior citizen's exemptions

When my Dad passed away, he gave his 2nd wife Life Estate. She is responible for paying the taxes, keeping up maintance and paying the homeowners insurance.

But the children own the house.

My Father was a senior citizen and he had these 3 exemptions:

senior citizen assessment freeze

senior citizen homestead exemption

general homestead exemption

on the prpperty taxes of his home.

(Home is paid)

The 2nd wife still resides in the home (life estate), she is also a senior citizen. The question:

Is she entitled to these exemptions,even though the children are the owners of the home (property).

If she is not entitled and tries to get these exemptions for the property taxes. Is this legal?

If she tries to get the exemption and succeeds (if illegal) would the children be responsible for back taxes and penaltieswhen she dies?

A life estate is a property right. She should be eligible for the exemptions. To be sure, contact the County Assessor or Treasurer where the house is located to inquire.
