Legal Question in Traffic Law in Illinois

Accident with no license and no insurance

I was involved in an accident where I rear ended the other vehicle and received a ticket. The driver of the car I hit had no valid drivers licence and no insurance. I have liability insurance and had collision. I am 18 years old and my mother cosigned for a loan on my car but canceled the collision without telling me. I am on her insurance but still owe $3000.00 dollars on the loan. My car was totaled and now I have to pay for something that no longer exsists. My court date for my ticket is December 22, 2004. What can I Do?

Re: Accident with no license and no insurance

You are double screwed. You are responsible for the damages to the other car despite that fact that the driver was not licensed or insured. The second part is that you are responsible for the payment of the car you were driving. It is unfortunate that you had no insurance to cover the damages.

I would suggest that you contact the loan company and see if they will settle for a lump sum payment. I have had success in settling these types of cases for 60% of the outstanding amount. But you would need cash to make the deal work.

Well, you are in bad shape. You are both liable for the damages to the other vehicle, despite the driver not having a valid DL or insurance, unless you have some sort of valid defense. I would suggest that you try to retain a lawyer to help you. Good Luck!
