Legal Question in Traffic Law in Illinois

Aircraft enforced speeding ticket

I recieved a speeding ticket that was part of a speed trap(numerous stae troopers pulling many people over at the same time) in illinois. I was told the speed was checked by aircraft. Further down the road there was a sign that informed drivers that speed was being checked by aircraft. I was wandering if those signs(informing of the aircraft) are required to be there and if so do i have a case since the sign was after where they were pulling people over.

Re: Aircraft enforced speeding ticket

I don't believe that you have a "notice" defense based on the lack of signage. Practically speaking, however, the state police planes usually have a two member crew, a pilot and a co-pilot; sometimes a passenger in back. Lots of nice questions about how one can fly a plane and chart the speed of cars, IF the person who actually checks the speed of the car actually shows up in court. Usually the police agent who wrote the ticket shows up in court. He is not a competent witness to testify as to speed. The state bets that you will pay the ticket on the intimidation factor. Get it? Good luck!
