Legal Question in Traffic Law in Illinois

Collision

I was involved in a car accident on an interstate highway in November 2004. The roads were very icy. As I put on my blinker to signal that I was coming off at the next exit, the car behind me tried to go around me and started skidding and side swiped my car on the driver passenger side sending me into a spin. I don't know what happened after that but when my car finally stopped, I was in the middle of oncoming traffic with trucks and other cars trying to avoid hitting me, however another car was unable to avoid me, and made contact with my car. Because I did not have insurance I got papers from the state requsting a fee and insurance to keep my liscense active, which I did and that was the last I heard. It wasn't until I was involved in routine traffic stop because my headlight was out that I found out my liscense was suspended. So, I went to court on that and had to pay another $100 fine for driving on a suspended liscence. I wrote to springfield to request a hearing which happened in January. Now today, I received a letter from the insurance company of the person who hit me trying to sue me for $6,000 and have to appear in court very soon. I need some legal advice before my court date.

Re: Collision

How did you plead to driving on a suspended license? Since you have no insurance, you may be responsible for any judgment entered against you as a result of this collision. I would advise to answer the complaint alleging affirmative defenses and/or would consider filing a counter-claim for the damages you sustained, since this was the other driver's fault.

Please feel free to call me with any questions you may have.
