Legal Question in Traffic Law in Illinois

A couple weeks ago I received my first ticket ever for being a passenger in a vehicle with open alcohol. Then 2 weeks later I then received a speeding ticket. I've never had any kind of ticket for 6 years then all of a sudden get 2 in less than a month, just my luck!! Well my question is, it says that I am only allowed court supervision for one ticket a year. Should I request it for my speeding ticket? If I do that then what will happen to the open alcohol ticket? Will that stay on my record? Does that even go on my record? Thanks!!

First of all, you should attend both of your court dates with the hope that the officer does not appear or the prosecutor makes the decision to dismiss your charges. This may be possible with your open alcohol container charge.

You should also attend your speeding ticket court date. This is the charge in which you should take supervision. The reason is that speeding is a moving violation in Illinois and convictions for moving violations in Illinois can lead to a suspension of your driver's license. Supervision is not a conviction and will thereby protect you in the future should you get another speeding ticket.

Please call my office if you'd like to discuss your matter in greater detail

good luck
