Legal Question in Traffic Law in Illinois

My daughter (18) was leaving a house at 3am (as a designated driver for drunk kids in her car) She backed up into a rented car that someone was responsible for at same house and dented it. Instead of exchanging info. she left and later communicated with them, sending a pic of her car (with no damage) and license plate. Well they called the cops at 10:30 am and a cop came to our house and said that my daughter was a "hit and run" driver, and that 2 people saw her do it. However, the reason they didn't call police until next day because they were underage drinkers in the house. My daughter admitted to doing the damage to the car and the cop gave her 2 tickets; One for illegally backing up ? and one for leaving the scene of the accident. (no one in the car) She has a court date coming up where I guess she will be fined. My question: Should we hire a lawyer or will it make no difference either way? She has had one other ticket for speeding back in Fall of 2013.

Because of your daughters age I would certainly recommend having an attorney go with her to court. The reason why is because your daughter is being charged with leaving the scene of an accident which is a moving violation. This could have serious consequences to her ability to drive in the future and could lead to the suspension of her license. An attorney can go into court and based on the circumstances surrounding your daughters case negotiate so that while she may still be fined, she will be fined for an amended charge which is not a moving violation and will not affect her driving privileges now or in the future.

If you would like to discuss the matter feel free to call my office at (773) 791-9682 and I'll be happy to explain your options.

Good luck
