Legal Question in Traffic Law in Illinois

How to deal with two moving violations in one week

My 17 year old son received two moving violations in one week, one for speeding (25 over) and the other for a minor accident (failure to reduce speed to avoid an accident). What is the best way to respond to these tickets? As I understand it, if you are 17 years old, two moving violations in 24 months will result in a suspension of the drivers license. If he gets court supervision on the first one, how is that affected by the second one (different cities but they are in the same courthouse).

Re: How to deal with two moving violations in one week

First of all you know that your son should not plead guilty and just pay a fine on either case.

Second, some prosecutors will amend the charge to a non-moving violation in return for payment of a higher fine. This avoids a conviction on the moving violation. Other times, it may be possible to work out some plea bargain other than the standard "supervision". In most places, once a defendant pleads guilty in order to get "supervision", he will not be allowed to do so again at least for a substantial length of time. You need to hire an attorney to check into the specific possibilities in the locale where these charges are pending. I handle cases in many counties throughout central to southern Illinois, and you are welcomed to call for a free telephone consultation if you wish at 314-727-2822.
