i am on e-m (house arrest) for driving on suspended. i owe 180 days county or 1 yr. prison. yesterday at court the state attorney said that my e-m time wouldnt be credited. the judge set a later date to see if he was correct. will my time count towards my sentence

Whether your house arrest will be credited towards your time is entirely up to the judge's discretion. There are cases discussing this issue. I recommend you have an attorney argue on your behalf to present the law and get you the credit.
