Fail to yield to railroad
I was issued a ticket for''disobeying signal for aproaching train''. It was snowing , 6:15 pm(dark). I was very, very close, when railroad lights went on..continued through..i would say the gates probably started to come down as I was crossing. What are my chances of beating this? I feel I would of had slam on my brakes and probaly would of ended up on the tracks due to the snow and driving condtions.? Police stated to me he would not give a warning ''he was on railroad saftey patrol, a new program that our town started in Jan 07, and it is zero tolerance. What are my chances of beating this. I have never been in traffic court. Thank you

Well, this is what we term a "BS" ticket given the driving conditions. The problem you have is that you will need the assistance of a lawyer, as this will be, in my opinion, too complicated for you to represent yourself. Good Luck!
