Legal Question in Traffic Law in Illinois
When home confinement is an option, does the judge or the sherriff's dept at the county correctional facility decide if that happens?

If a person is already locked up then it depends on the facility. However, the option to grant home confinement usually begins with the State's Attorney, the judge and finally the facility. If the State or the facility objects, then usually it will not happen without a court order too.
