Legal Question in Traffic Law in Illinois

incorrect address and no red stop signal

I was pulled over for running a red light. It didn't turn red until I was in the middle of the intersection. If I try to fight this will it be he said-she said?

Also, the address on the ticket is wrong. I have filed an updated address with the Secretary of State but the old address is still on my license. Can I get the ticket dismissed because of the inaccuracy?

Re: incorrect address and no red stop signal

The fact that the ticket does not have your current address on it is of no legal consequence. If you want to go to trial and testify that the light was not red when you entered the intersection you have every right to do so. Of course the officer will say that the light was red when you entered the intersection. In most cases, the Judge is going to believe the officer and find you guilty. It almost always makes better sense to hire an attorney and enter into a plea bargain which will avoid any conviction, even if you personally do not believe that you are guilty. I have handled a large number of such cases, and I might be able to help you. If you would like to call me for a free telephone consultation, you may call 314-727-2822.
