Re: Jurisdiction
This must be 65th St. between Cicero and Harlem. The answer to the question is, it depends. It depends on the nature of the ticket that you were given and the reason that the officer stopped you. For stops outside their jurisdiction, officers need to use a particular section of the law relating to citizens arrests, and also the stop needs to be for something other than an ordinance violation. This is a very tricky question, and one I addressed in an appellate court case called People v. Kirvelaitis. If you google that you might read what the court said about an out of jurisdiction stop for speeding. If it is a simple traffic ticket, it may the subject of a motion to dismiss. If there are further issues you may wish to contact an attorney. At one time I was an Ass't State's Attorney in the Bridgeview Courthouse where this ticket will be going.
