Legal Question in Traffic Law in Illinois

Left Turns

My son was driving my car. He approached an intersection with a traffic regulated control device. He stopped for a red light. When the cross traffic cleared the intersection the light turned green. A sixteen year old boy in the Southbound lane made a left turn on the green light striking my car on the front driver's side. He contended that he had a green turn arrow and was not issued a ticket. He was also in direct violation of the Illinois Graduated Driver's License Law. He had two fifteen year old passengers in his car to whom he was not related. Legally he is not allowed more than one. He was not issued a ticket for this either. My car is unsalvagable. His insurance company refuses to pay for damages because the 16 year old told his insurance company that my son ran a red light. I sent a copy of the police report to the insurance company along with written confirmation from the Illinois Department of Transportation that the left turn arrow can not be accessed from the rest state. The insurance company refuses to discuss this with me or respond to my requests for a hearing. What can be done to get the insurance company respond appropriately?

Re: Left Turns

There is nothing you can do to make the insurance company to act "immeidately". You can file a complaint with the Illinois Dept. of Insurance, but you should not hold your breath. Interestingly, you did not mention whether YOUR SON, was issued a ticket, and what the dispostion of that ticket was. This could have something to do with your situation, to say the least. You need to hire a lawyer to help you through this mess. Good Luck!
