Misdemeanor - Class A
Hello,
I was wondering what options if any I have in the following matter: I got an speeding ticket for doing 96 in an 55 zone which is an ClassA misdemeanor.
(This site will not let me use the first letter of the English language alone so i have used ''an'' instead - excuse the English)
I am well educated, gainfully employed and have had one other ticket for which I went to traffic school (so that is not an conviction, right?)
What are my options - Is there any chance for jail time?? Also, what are the chances of getting off - NO conviction - but fine or guilty toa lesser charge etc..

In July of 2000, the state of Illinois made speeding in 40 mph over the speed limit a class A misdemeanor, which carries up to 364 days in jail and/or a fine of up to $2,500. That's the bad news. The good news is that as a jailable criminal offense, you must have the 40 mph proven beyond a reasonable doubt. These cases often do not include radar, and police pacing at those speeds is often subject to error or estimate. You may have a reasonable chance at trial, or possibly a chance to have the speed reduced to something under 95 mph in return for a plea. Since it is a jailable offense, you should not approach this matter without competent legal counsel.
