Legal Question in Traffic Law in Illinois
Missing Information on a citation. Is it grounds for dismissal?
If the officer fails to complete the entire citation, for example, must appear box, or time of court, is this grounds for a dismissal of the citation?
Thanks.

Re: Missing Information on a citation. Is it grounds for dismissal?
It should be grounds for dismissal, but as a practical matter, rarely is. The reason for this is that the State orally moves the court to correct the deficiency "on the face" of the complaint, thereby effecting a cure. Additionally, court dates now are rarely set by the arresting officer; they are set by the court, and the defendant is notified of a court date by postcard. Another reason why one should be sure that the Secretary of State has your correct address. Good Luck!
