Legal Question in Traffic Law in Illinois
Mistake on Court Apeearance Time
I received a ticket for a minor accident that requires appearance in court. Officer made a mistake on ticket and my court time is stated at 3 AM. What is my obligation? If I do not appear, will I have issues in spite of error. If I appear at 3 AM with court closed, will ticket be dismissed? Will ticket be dismissed with call to court due to error?

Re: Mistake on Court Apeearance Time
Your case is set on a Court's docket at a certain time on a certain date. If you do not show up in Court or have an attorney represent you the chances are excellent that a warrant will be issued for your arrest and you may also be charged with the separate offense of "failure to appear". Poor penmenship or even an outright error by the officer writing the ticket is no excuse, and your case will certainly not be dismissed. Look at the ticket again. Might it say "8:00 a.m." instead of "3:00 a.m."? In any event, you should either call the court clerk to see what the actual time of your court appearance is, and then show up, or you should hire an attorney.
