Legal Question in Traffic Law in Illinois

Last night I was driving home a little before 12:30 AM. I was going 59 mph in a 55 mph zone and I know this because I had my cruise control set. I saw a car coming towards me about a 1/2 mile away so I slowed down. It turned out to be a cop and he gave me a ticket for: going 72 mph in a 55 mph zone and for curfew. I am 17 years of age and I know I was not going 72 mph. What is the curfew law for 17 year olds in Illinois?

If you are 17 the IL curfew laws would not apply. Unless he is citing a different law, like an ordinance. The Child curfew law in IL is 720 ILCS 555/1 which states that It is unlawful for a person less than 17 years of age to be present at or upon any public assembly, building, place, street or highway at the following times unless accompanied and supervised by a parent, legal guardian, or other responsible companion at least 18 years of age approved by a parent or legal guardian or unless engaged in a business or occupation which the laws of the state authorize a person less than 17 years of age to perform:

1. Between 12:01 a.m. and 6:00 a.m. Saturday;

2. Between 12:01 a.m. and 6:00 a.m. Sunday; and

3. Between 11:00 p.m. on Sunday to Thursday, inclusive, and 6:00 a.m. on the following day.

I suggest you get a good traffic lawyer for your day in court. Ask to confirm that he clocked your auto speeding and that his radar gun was properly functioning and calibrated previously too. Police make mistakes too. Best of luck. Attorney Alex
