Legal Question in Traffic Law in Illinois
In November of 2008 I missed a court date for a ticket with no insurance(illinios)... The Fine is 2,000 plus dollars. I am a college student who cant afford to pay that amount. Can I some how appeal that decision or have the fine reduced? My licence was suspended so I cant go get Insurance. Can I claim this violates my 8th amendment right of excessive fine and fees?

Some facts are missing -- like how much the fine was when it was imposed. The fact that you didn't show up and the fine grew is not the court's problem. My question is since you are now only in college were you a minor at the time the fine was imposed? If so where were your parents/legal guardians? Whose name was on the car? You should seek out an attorney to help straighten this out or it will dog you. And while the ticket itself may not show up after a while, the fine will dog you. Appeal? The time to appeal appears to have expired a long, long time ago -- usually it's 30 days after the trial court rules (here it was the traffic court) unless it was extended before it expired. There is a very slim to none chance that a prosecutor may be willing to deal with you on this, but it may be worth pursuing especially if you haven't been violating the suspension since, but without an attorney to help guide you, you could be hurting yourself.
