Legal Question in Traffic Law in Illinois
passing stopped school bus
Was taking my daughter to school and pulled into the parking lot. Buses were stopped on the right hand side and two cars in front of me and myself pulled up on the left and parked into parking spaces to drop the kids off. I didn not see any flashing lights or stop sign extended. The bus company called the police and I was issued a ticket for passing a stopped school bus with its flashers on. I did not see the lights on or the stop stick. I went to court and plead not guilty and have to go back. What is the penalty for this? They said a fine and suspended license. I can not not have a license because I am a single mom of 3 children under the ages of 4. Is there something I can plea bargain with to not get the suspension. Any answers would be greatly appreciated, I dont know what to do in this case.

I've represented another individual with the same problem. These cases can be tricky, and may require more than one court appearance. Unfortunately for you, it has been my experience that the state takes a tough stand on these, and may not wish to plea bargain at all until the date of the eventual trial. If this case is pending in Du Page, Kane or Cook (3d Dist.) I would be pleased to speak with you about this situation. If the case is pending in Cook, with a Downtown venue, I can refer you to someone who can help. If this case is pending anywhere else, you may consider calling the local bar association and ask for a referral to an attorney who practices in the area of traffic law. Above all, Good Luck!
