Legal Question in Traffic Law in Illinois
Photo Radar
I was issued a ticket by a photo radar unit alledging that I was driving 70 in a 55mph zone. The place where the ticket states ''Specific Location'' is not consistent with the photo that accompanied the ticket. It is actually 6.5 miles away and says I was heading north instead of south (as the photo indicates). Is this grounds for dismissal?

Re: Photo Radar
The facts that you provided do suggest that you have a defense. A salient question is what municipality issued the ticket. Before you have a right to see a person in a black robe, you might have to see an Administrative Law Judge, or such. You need to hire an attorney in your locale. GOOD LUCK!
Re: Photo Radar
The facts you give us might provide a defense, which, if believed by the judge at trial, might result in a dismissal. It is also possible, but not likely, that the state's attorney can be persuaded by these facts to drop the case. I would strongly suggest that you hire an attorney and follow your attorney's advice. Good luck.
