Legal Question in Traffic Law in Illinois

Request discovery for traffic violations

Dear Lawguru,

I am having difficulty finding information about my right to full discovery for a traffic ticket I am fighting. I have researched the freedom of information act and the human rights act, but have not been able to find the exact information I need. Could you please tell me if I have a right to full discovery for a speeding ticket. I would like to obtain the police officer's radar and calibration records, but the states attorney has declared that I do not have the right to this information for a speeding ticket (stating it is not a criminal case, but what is it then?). I really need this information in ordered to prepare for my case. Could you please lead me in the right direction? I would also like to know how I may find another Illinois traffic (speeding) case that has been granted full discover in Illinois so that I may present this to the judge.

Thank you for you help in this matter.

Well, you probably didn't understand the SA, and (s)he is not your "friend". The way to get this info is to issue/serve a subpoena upon the PD. Good luck!
