Driving with suspended license twice. Will I go to jail? Help!!!!!!

You have every reason to be concerned because of the seriousness of the offense, but there is no reason to believe that you will be going to jail on a second charge of driving while suspended. I have handled multiple, multiple driving while suspended charges for the same individual at the same time with no jail time imposed. A lot depends upon your specific facts, and what disposition was made of the first charge. Are both charges in the same Court? An attorney will probably be able to work something out whith the state's attorney in most cases, especially if you can get your license reinstated. The charge carries with it a potential jail sentence of up to 364 days and a fine of up to $2500. The more times it happens the higher the likelihood of jail. It also depends upon why you have been suspended. Although all suspended cases have the same potential penalty, the courts look at some suspensions as more serious than others.
