speeding ticket
my 16 year old son who's had his license 6 months got a speeding ticket for doing 82 in a 55. It's his first ticket. Is it possible he can be denied supervision? Should I get a lawyer? I don't really see what a lawyer would do. He pleads guilty and asks for supervision. Either the judge gives it to him or not. How would a lawyer better ensure he gets supervision? If we go without a lawyer and he pleads guilty and doesn't get supervision can we then get a lawyer to fight and get it over turned and get supervision? Thanks for any help.

I have been handling similar caases in various Illinois counties for almost thirty years, and from my experience I can tell you that your son would be better off with an attorney than without one. In many counties the state's attorney's office will treat an attorney better than they will a pro se defendant. Sometimes this is a matter of professional courtesy. Sometime it is because the defense attorney knows what to say, and sometimes it is because the state's attorney knows that the defense attorney can make the state's attorney go to trial, perhaps twice, or face an appeal, or otherwise spend a lot of time and effort on this relatively minor case. If the Court is not inclined to simply approve supervision, the defense attorney and the state's attorney may be able to find some other way to satisfy both of their needs, and obtain the approval of the Court. All in all, there is no doubt that using an attorney would be the best option. Simply pleading your son guilty and asking the Court for supervision might work in certain counties, but it seems like gambling with your son's record and future to me. Good luck.

Your son, because of his age, may be facing a "discretionary suspension." It is in your son's best intrest to hire a lawyer.
