Legal Question in Traffic Law in Illinois

Suspended License

Recently I was arrested for driving on an (unbeknownst to me) suspended license. I was also cited for having an expired registration and no proof of insurance (although I do have insurance but we never got to that point!). The policeman stated that he had to take me down to the station to write me a citation. My court date is in a couple of weeks and I'm not quite sure what to do ! I guess I need a lawyer but I cannot afford one. How do I go about getting a ''court appointed'' attorney ? Do I need to go to the courthouse a few days ahead of the court date to find one ??? I also understand that I can go to jail. Would I be given some time to straighten out my affairs, give notice to my employer, etc. before I go? I've never been involved in anything like this before and I'm scared to death!!

Thank you

P.S.: The suspension was removed from my license a couple of weeks ago (passed the emissions test) and I've updated my registration. I've always had insurance so there was nothing to update on that.

Re: Suspended License

Despite the fact that you have what amount to equitable defenses, there is a potential for jail time and a fine (364 days and $2500 respectively). In my experience, however, judges don't jail people for these offenses. I don't believe that you can handle this yourself. Costs of a legal professional vary, and the county in which the charges are pending have an impact regarding fees as well. Re: Suspended License

Regardless of the reason for the suspension, the potential penalties are up to 364 days in jail and/or a fine of up to $2500. Given those circumstances you are advised to be represented by counsel. Going to the court in advance of the court date will not help in regards to obtaining a public defender as the judge needs to determine if you are eligible, and absent appointment by the judge the public defender does not represent you. It sounds as though your matter can be handled in a single court date and under that situation you are best to bring counsel with you. If you wish to speak about potential costs, I can be reached at 630-257-8280

Re: Suspended License

I agree with Mr. Shestokas, you should hire an attorney before your court date. The matter may by disposed of in one court appearance. Call or email if you would like to discuss.
