Legal Question in Traffic Law in Illinois
traffic violation
My 17 yr.old daughter received a ticket for going 38 in a 25 mph school zone. No previous tickets.....driving for 6 mths. The Will County judge did not give her a chance to speak and only said ''come back in December and bring a lawyer''. We know that a school zone is a very sensitive issue but why a lawyer and why no explanation? Thanks

The reason the judge wants you to bring a lawyer is that it is possible that your daughter could receive a discretionary suspension from the Secretary of State because of the speeding in a school zone. It's her age and inexperience. One reason the judge did not explain things to you is because he is not your lawyer. He cannot give advice or explanations. That's the job of your lawyer. Good luck.

The judge has discretion to not let your daughter defend herself pro se (without a lawyer). It is possible that he made her get a lawyer so that her parents would be upset at having to pay legal bills and would discipline their daughter.
