Legal Question in Traffic Law in Illinois

how to vacate a judgment of forfeiture

How do I argue/fight a judgment of forfeiture in court? This is from a court date I missed from 6 years ago that I didn't know about until a month ago. What do I do in court? What do I say? They were still sending items to that old address so I had no idea this was under my name. Thanks in advance.

This depends on the type of case and type of forfeiture. If it is a minor case then you can motion the case up and tell the Court why you have waited so long and if you plan on paying the ticket or are requesting a new court date. Cook County will typically allow this. If you want, contact my office and I can give you more information.

No offense, but it would seem to me that this is an issue over your head. I believe that you need to retain the services of a lawyer as soon as possible to straighten out this mess. Since the gov't authorities routinely send mail to the address shown on your DL and registration, I think that it might be likely that you did not properly submit changes of address. Good Luck!
