Legal Question in Wills and Trusts in Illinois
3 years and counting
My father has been deceased over 3 years now. I have an attorney overseeing my position as an heir but nothing is being done to successfully get answers to where my dad's finances had gone. Dad came into money prior to his death in 2004 and since he was suffering from Parkinson's disease at the time and brothers 1, 2, 3 and 5 had manipulated him to no end. I had no control over the situation as they banded together to put dad where they wanted him. I have exhausted more time and money into this and I am at a crossroads. The biggest situation that I am not willing to let go of is the fact that I had requested my dad's tax filings to include all information of his cd accounts. I know that before his passing he was waiting on the finalization of an inheritance and that he had at least 5 cd accounts of substantial amounts. Only 50k is accounted for and among the 4 brothers, they have been doing everything they can with the attorney to conceal the funds. I need some help but without any funds, I am at a loss. What can I do at this point? Brother #5 who is the executor, wants to close out the estate and will do so without my signature, this is in process of being presented to the judge. This is just one of a miriad of diasters.

Seems to me like you need to ask for an accounting. If the executor (or his attorney) does not provide one to you, you can petition the court for one. Generally, when an estate has been open for over a year, the judge requires it.
Good luck to you.
