In Illinois, an Executor must administer an Estate in a lawful manner and must honor a fiduciary duty to each of the Estate's beneficiaries. If you believe that the Executor is failing in these tasks, consult an attorney. Your attorney will assess whether you have a good chance of seeking corrective action from the Courts. Also, your attorney can help you negotiate with the Executor's attorney. Once the Executor finds out that you have hired an attorney, he may begin to behave in a very different manner.
