assets of an estate

father died no will. four children are the survivors. three children are in agrement and have hired a lawyer. the fourth child has hired his own lawyer, and says he knows nothing about the assets and says everything is his and has and is selling off little by little the assets. we are in probate. if the fourth child dosen`t agree with the other three about dividing the assets equaly amoung the four children. will the assets have to be auction off or sold off. just because one does not agree.

It depends on who the administrator(s) are, and if all the children are beneficiaries (I assume they are under IL intestacy). More information is needed to properly answer the question. I can tell you that the three children can (and probably should) immediately get a court order stopping all selling of assets by the fourth child until the matter is figured out.

I would need to know if the father was married as well.
