My grandmother financed a car that she gave to me 4 years ago and it is in her name. I have been making the payments since day one and am the only one driving it. My grandmother is deceased now. There are only a few payments left until it is payed off and I would like to get the car in my name. The finance company says I need a power of attorney to get in switched into my name. How can I get that if she really has no property and no will? I do not want the car taken away and would like to know what I can do. Can you help?

A person who dies in Illinois without a will and has an estate worth less than $100,000 can have their estate administered by a "Small Estate Affidavit."

Talk to an attorney who routinely deals with estate planning about your situation. He/she will be able to advise you on how to go about having one drafted that will give you the authority to change the title.
