Legal Question in Wills and Trusts in Illinois

bequests

my mother left her house to me. I am the executor. to her other daughter she left $1,000. In order to acquire the house I had to take a mortgage to payoff a reverse mortgage and one other estate debt. Am I also responsible for paying the $1,000 bequest to her other daughter? There is no cash left. Mom left all of her property (personal and real) to me. I had to use the joint accounts to pay off other estate debts then had to take out a mortgage to payoff the reverse mortgage. I will also be responsible for the legal fees.

Do I have to pay her other daughter out of my own pocket or can I just give her the painting and necklace that my mother left her with a note that the estate assets were exhausted?

Re: bequests

It seems that you both received specific bequests.

If there is no money left in the estate, the $1,000 does not have to be paid using the house as an asset. It simply won't be paid.

Good luck to you.
